Sub:   Submission of Memorandum on 7^th CPC related issues to the     Implementation Cell by the Department of Post: Request to supply the   copy.

Madam,

            Your kind attention is invited towards both Federation letters dated 07.03.2016 on the subject cited above. In this connection , we would like to bring  to your kind notice  that a JCM Departmental Council  Meeting  was held on 08.12.2015 under  your Chairmanship in which  the issues related  to Pay Commission  were discussed in detail  and it was  decided  that a copy of Memorandum to be submitted  to Implementation Cell  will be  given to Federations, but inspite of  several requests verbal  and in writing  made to you and  Member(Personal), the copy of the same  has not been supplied yet.

            Again it has been informed vide Director, SR & Legal  letter No. 06-04/2015-SR dated 09^th March, 2016  that one meeting  will be  held  on 31.03.2016 under your Chairmanship at Directorate on the same  pay Commission  related issues and prior  to it  one meeting will also be held on 28th March 2016 with Director (SR).

            We are very sorry to inform you that in such circumstances we shall not be able to attend the meeting as scheduled. When any decision  is  taken in highest forum and assurances are given  and  if the same is not materialized  and subordinate officers  do not comply with the orders of highest officers  than what’s  the use of holding such meetings again and again. This is merely wastage of time.

            Further we would like  to mention  here that  at the time of submission of Memorandum to Pay Commission  we had requested  several times to supply  the copy of the same  but it was not supplied  but it has been obtained by some retired officials under R.T.I.

            Therefore it is beyond to understand as to what is there which is to be concealed from the unions.

            Even now we have time. Therefore PJCA requests to kindly supply the copy of memorandum submitted to implementation cell and Pay Commission, so that the matter can be discussed in the meeting.

            It is therefore, requested to kindly take necessary action in this regard.

The NFPE unions of Guntur Division made an excellent arrangements for accommodating the visitors in the hall and food arrangements etc., deserves all appreciation. Com.M.Ramakrishna, Com.Subbarao, Com.M.Srinivas, Com.Ramarao, Com.Masthanrao, Com.Burraiah and many other comrades in the team took all pains to made the programme a grand success.

New Delhi: Employees of autonomous institutions like central universities and AIIMS will come under government scanner now which will keep track of their performance.

Under Fundamental Rule 56(J), the government has the "absolute right" to retire, if necessary in the public interest, any Group A and B employee who joined service before the age of 35 and has crossed the age of 50.

Also, a Group C government servant, who has crossed the age of 55, can be retired prematurely under the rule.

The Department of Personnel and Training (DoPT) today asked all administrative ministries to ensure that autonomous institutions have adopted the provisions of FR 56 (j) and that they are strictly followed.

In case where the autonomous institutions have similar provisions in their rule books, the administrative ministry may ensure that they are followed in letter and spirit, it said.

In case there is no such provisions exist in regulations governing their working, the administrative ministry may ensure that the action is taken to put in place such rules as may be necessary, the DoPT said in a communique to all central government secretaries.

There number of autonomous institutions and bodies under the administrative control of central government that include Aligarh Muslim University (AMU) and All India Institute of Medical Sciences (AIIMS), as per a government directory.

The Centre is conducting review of its employees working in ministries. While addressing a conference here in November last year, Prime Minister Narendra Modi had said 45 senior officers have either been removed or faced pension cuts for "unsatisfactory performance and delivery in public service".

The Public Investment Board has already approved the Rs 800-crore proposal of India Post and in 15 days, it will go to the Cabinet for final approval. "We have selected Deloitte as the consultant for payments bank. The agreement will be signed on March 14," an official in the Department of Post (DoP) told PTI. 

India Post payments bank will primarily target unbanked and under-banked customers in rural, semi-rural and remote areas, with a focus on providing simple deposit products and money remittance services. 

The pilot for the payments bank is set to start from January and the full-fledged operations will start by March. As many as 40 international financial conglomerates including World Bank and Barclays have shown interest to partner the postal department for setting up the bank. 

Reserve Bank had granted payments bank permit to the department, which is already into providing financial services and has 1.55 lakh branches across the country.

Dear GDS Comrades,

The One man Committee headed by Shri Kamalesh Chandra asked to submit feed back from all Gramin Dak Sevaks. Letter addressed to all GDS in English & Hindi also.

It is informed to our CHQ in many Circles / Divisions the local administration asked our GDS comrades to send their views to divisional heads to forward to the GDS Committee through administration also.

AIPEU GDS (NFPE) prepared one model copy on all GDS demands/issues for the information and awareness of the GDS comrades to forward it to Shri Kamalesh Chandra, Chairman, GDS Committee individually from each GDS with their address and signature.

The copy shall be posted to the Chairman, GDS Committee at the earliest from GDS in all divisions in all Circles.

All CHQ office bearers / Circle Secretaries / Divison & Branch Secretaries / Representatives of AIPEU GDS (NFPE) is requested to circulate the copy among GDS members and request them to send the same to the Chairman, GDS Committee by their own from BOs as early as possible.

Further requesting our NFPE leaders in the divisions to cooperate and guide the GDS comrades in the divisions to send the feed-back to the GDS Committee at an early date.

All of you are aware that the All India Postal Employees Union – GDS (NFPE) was formed in the year 2012. Now almost four years are going to be completed since the formation. During this peiod, the Federal Council of NFPE, which is supreme decision making body of NFPE has decided to grant “ASSOCIATE MEMBERSHIP” to the new union. The All India conference of all affiliated Unions / Associations of NFPE also decided to extend full cooperation and support to AIPEU GDS (NFPE).

The AIPEU-GDS(NFPE) has formed Circle/Divisional Branches in 80% of the Circles and Divisions. It’s first All India Conference was held at Chennai in March 2013 and 2^nd All India Conference at Shimla in September 2015. It has conducted various agitational programmes including strike along with NFPE and Confederation.  Due to the efforts made by the NFPE & AIPEU-GDS(NFPE) both Confederation of Central Govt Employees & Workers and the National Joint Council of Action (NJCA) of JCM Staffside  organizations (Railways, Defence, Confederation) have included the demand for grant of Civil Servant status and grant of all benefits of regular employees on pro rata basis in their strike charter of demands as an important demand. Postal Joint Council of Action (NFPE & FNPO) has also included the GDS demands as number one demand in their charter of demands.

The ‘recognized, GDS union is not a part of NFPE or Confederation. It is an individual – self centered organization. During the last 15 years the recognized GDS union could not settle any of the demands of the GDS. Upto 2000, GDS conducted joint struggles including strike under the banner of NFPE and whatever benefit has come to the GDS is only because of the struggles conducted by NFPE. After 2000 the GDS Union started separate functioning and started to divide regular employees and GDS. It is refused to join the joint programme of NFPE and always conducted separate programmes. Recognized GDS Union chould not settle any of the demands of the GDS, instead the GDS lost their existing benefits one by one. The Gramin Dak Sevaks have lost faith in the recognized GDS union and it has become a dead-horse. Now majority of GDS are convinced that only through joint struggle under the banner of NFPE, we can make improvement in the wages and service conditions of Gramin Dak Sevaks.

It is in the above background, the importance of new GDS union is to be understood. The new GDS union AIPEU GDS (NFPE) believes and stand for the joint functioning and struggle along with the NFPE and Confederation. NFPE has already given clear instructions to all Circle, Divisional Secretaries to form the AIPEU GDS (NFPE) in all Divisions and Circles. The AIPEU Group-C (CHQ) and AIPEU Postmen & MTS (CHQ) have also given instructions to all P3 & P4 Divisional, Circle unions to form the AIPEU GDS (NFPE) in the Circle/Divisions.

GDS membership verification orders will be issued in February/March 2016. We have no doubt that the AIPEU GDS (NFPE) will become the number one recognized GDS Union. The authorization letter (i.e., declaration form) should be obtained from each individual GDS and to be countersigned by the Divisional Secretary or Authorized Representative of AIPEU GDS (NFPE). Only Divisional Secretary or Authorized Representative can countersign the Authorisation letter. Hence the formation of the Divisional Union or an ad hoc Committee with a Convener in all Divisions is the first prerequisite for Membership verification.

As per the Constitution of NFPE, P3 & P4, all the Circle Secretaries and Divisional Secretaries of P3 & P4 should implement the decisions of NFPE, P3 & P4 CHQs. Inspite of clear instructions by NFPE CHQ and P3, P4 CHQs some of the Circles and Divisions have not formed the Branches of new GDS Union i.e., AIPEU GDS (NFPE).

Divisional Secretaries of P3 & P4 are still conducting meetings jointly with the old GDS union which is not an affiliate or Associate member of NFPE. The managing bodies of NFPE, P3 & P4 have decided to take disciplinary action against those Circle/Divisional unions for non-implementation of the decisions of NFPE, P3 and P4 CHQs including withdrawl of recognition. Hence this letter is issued.

All Circle / Divisional Secretaries of P3 and P4 are once again requested to implement the following decisions before 20-03-2016 WITHOUT FAIL.

1.  Form Divisional Union or Adhoc Committee of AIPEU GDs (NFPE) in all Divisions. If it is an Adhoc Committee, one convenor should be elected.

2.  Intimate the name, designation, office address with pincode & Mobile Number of the Divisional Secretary or Adhoc Committee Convenor to the (1) Secretary General NFPE

(2) General Secretary AIPEU Group ‘C’ (CHQ)

(3) General Secretary AIPEU Postmen & MTS (CHQ)

(4) General Secretary, AIPEU GDS (NFPE),

It is further instructed that , hereafter if any Divisional Union of P3 & P4 conduct joint programme with any/GDS Union which is not an affiliate or Associate member of NFPE, it will be viewed seriously and disciplinary action (including withdrawal of recognition) will be taken for violation of directions of NFPE, P-3 & P4 CHQ.

            All General secretaries/CHQ Office Bearers

            All Circle/Divisional and Branch secretaries of all NFPE/FNPO unions.

Dear Comrade,

            An emergent   meeting of PJCA with available General Secretaries of both Federations (NFPE& FNPO) was held at NFPE office 1^st Floor North Avenue Post Office Building, New Delhi.

            After detailed discussion it was decided that along with NJCA programme , the following programme will be  organized on Postal   Charter of demands as mentioned below :

CHARTER OF DEMANDS

1.      Settle all 7^th CPC related demands submitted by NJCA.

2.     Grant of Civil Servant status and all benefits of Departmental employees on pro-rata basis to Gramin Dak Sewaks.

3.      Upgradation of Pay Scales of various cadres of Postal department by modifying the retrograde recommendations of the 7^th CPC.

4.    Implement Cadre restructuring agreements already signed before implementation of 7^th CPC report.

5.   Filling up of all vacant posts by conducting special recruitment in all Cadres of Department of Posts.

6.     Settlement of problems arisen due to roll out of CBS and CIS.

7.    Regularization of service and payment of revised wages of Casual labourers w.e.f. 01.01.2006.

PROGRAMME

            The following programme of action was chalked out:

(i)         Submission of memorandum by organizing lunch hour demonstration in front of  all Divisional offices and submission of memorandum to Secretary  Posts on 11.03.2016.

(ii)        Dharna in front of all Divisional offices on 18.03.2016.

(iii)       Dharna in front of all CPMG offices on 06.04.2016.

(iv)       Indefinite Strike along with NJCA on 11.04.2016.

            A joint letter by both Federations will be submitted to Secretary Department of Post on Pay commission  related issues and Cadre restructuring , 7 Point Charter of demands and Memorandum will be submitted  on 11^thMarch 2016.

           

            To mobilize and make the demands popular among the members, the following campaign programme will be launched by NJCA leaders in the following state capitals as mentioned below:
